三星手机和笔记本电脑面临USITC调查

美国国际贸易委员会(USITC)同意调查一起声称三星旗下手机、平板和笔记本电脑等产品侵犯了2件半导体专利的投诉。

 

当地时间10月31日,USITC宣布,在接到今年9月份来自Tessera Advanced Technologies的投诉后,USITC将启动对“晶圆级封装半导体设备及产品”的调查。

 

Tessera是一家专注于半导体封装技术的研究与开发的公司,该公司在诉状中提及2件专利,称三星在许可到期的情况下仍持续使用其技术。涉案产品还包含内置晶圆级封装半导体组件的笔记本电脑和照相机。Tessera诉称三星侵犯了其2件美国专利,专利号分别为6,784,557和6,954,001,名称分别为“包含构成于电极部分之间的扩散层的半导体设备”和“包含一个扩散层的半导体设备”。Tessera认为三星违反了美国1930年关税法第337条款,希望USITC据此给予三星有限排除令(limited exclusion order)及停止令(cease-and-desist orders)。

 

此次ITC起诉是Tessera及其旗下公司针对三星及其子公司发起的若干诉讼之一,目前双方的专利纠纷已经涉及共24件专利。据Tessera表示,这些发明涵盖许多半导体处理、接合和封装技术,以及成像技术。

 

目前,USITC尚未对此案是否值得立案做出裁定,该诉状将先由一名行政法官处理,由行政法官稍后先行做出初步决定。

 

Tessera首席执行官Jon Kirchner表示,早在2016年12月三星最后的一份半导体许可就已到期,“但我们相信,三星将会在未经授权、亦未支付给我们合理补偿的情况下,继续使用我们的专利技术”。

 

据Tessera网站所述,该公司由IBM实验室的3名科研人员成立于1990年,最初专注于研发。目前该公司通过收购FotoNation等方式不断壮大,成为“图像视频增强和分析”领域的领先企业。

 

 

迪士尼距成功异议他人“小飞象”近似商标又近一步

迪士尼距离成功无效其所称与其影片《小飞象》(Dumbo)名字过于近似的商标“Dumbo Lounge Sacks”,又近了一步。

 

当地时间10月31日(周二),美国商标审查上诉委员会(TTAB)发布了一则涉及商标“Dumbo Lounge Sacks”的缺席通知,原因是异议人迪士尼对该商标提出异议后,该商标申请人未按时提交答辩。

 

美国加利福尼亚州公司12th Bean此前于2016年12月申请在第20类(充气客厅家具)商品上注册该商标。在申请中,12th Bean提交了该家具的一幅图片,图中描绘了该商标由大象面部和象鼻构成字母“M”的单词“Dumbo”。

 

美国专利商标局(USPTO)于今年5月对该商标进行了公告,迪士尼则于9月提交了其异议申请。

 

据迪士尼异议申请称,“Dumbo Lounge Sacks”这一商标与迪士尼的Dumbo名称及商标“在声音、外表和意义上高度近似”。迪士尼表示:“事实上,申请人的‘DumboLounge Sacks’商标完整包含了异议人的‘Dumbo’商标,且‘Dumbo’是申请人‘Dumbo Lounge Sacks’商标中的首个单词也是最主要的单词。”迪士尼认为,由于迪士尼也供应与家具有关的商品,例如枕头、台灯和相框,因此12th Bean的商品与迪士尼的商品高度相关。“此外,鉴于异议人‘Dumbo’名称和商标的显著性及声誉,以及异议人在以影片、角色的名字和商标授权产品上拥有较长的历史,消费者习惯于看到异议人的‘Dumbo’名称和商标使用在众多产品和服务上,包括家具相关产品。”

 

迪士尼拥有包括第20类(相框镜子和枕头)在内的多个商品和服务类别的文字商标“Dumbo”。12th Bean最迟须于10月21日前答辩,但该公司并未按时答辩,因此TTAB发出缺席通知。12th Bean公司自裁定之日起有30天时间说明不应做出缺席判决的理由。

 

 

“阿迪三条纹维权系列”:阿迪对又一件美国商标提出异议

阿迪达斯“三条纹”商标


德国运动服装公司阿迪达斯(Adidas)日前对又一件美国商标提出异议,称该商标侵犯了其经典“三条纹”商标。

 

异议商标是由Dagoberto Sanchez于2016年5月在美国专利商标局申请注册在第25类(T恤、帽子和长袖运动衫)商品上的,商标图形是三条水平线下方绘有“三条金色横杠”。该商标于2017年5月进行公告,阿迪达斯于10月30日提交了其异议申请。

 

据阿迪达斯表示,阿迪达斯自1952年起便开始在鞋品上使用“三条纹”商标,自1967年起开始在其他服装上使用“三条纹”商标。该商标长期使用于凯蒂·佩里、赛琳娜·戈麦斯和坎耶·韦斯特等艺人赞助。“‘三条纹’商标不具有实际功能,公众认可并理解‘三条纹’商标可以区分和识别阿迪达斯的商品。”阿迪达斯称,‘三条金色横杠’商标与阿迪达斯商标“在外观和整体商业印象上”会导致“混淆性近似”,并且被识别的商品与阿迪达斯提供的商品相同且/或密切相关。

 

桑切斯须在12月9日前提交针对该异议的答辩。

 

阿迪达斯的“三条纹”商标一直以来都是众多美国商标异议案的中心,甚至与西班牙巴塞罗那足球俱乐部也有一起纠纷。今年3月,巴塞罗那俱乐部放弃了争论,放弃了一件“包含7条竖条纹的正方形”的美国商标申请。

 

零售商Forever 21也与阿迪达斯有着激烈的纠纷,主要围绕Forever 21在其服装上使用的条纹。同样是今年3月,Forever21递交了一起诉状寻求确认判决,而阿迪达斯则在7月份予以还击。“Forever21最近在其网站(forever21.com)上,以虚假和误导性标签‘改款阿迪达斯产品’提供假冒的阿迪达斯产品供销售。”阿迪达斯表示。

 



 

Samsung phones and laptops to face USITC investigation


The US International Trade Commission (ITC) has agreed to investigate a complaint that Samsung products, including mobile phones, tablets and laptops, have infringed two patents covering semiconductors.


Yesterday, October 31, the ITC announced it will probe “wafer-level packaging semiconductor devices and products” after a complaint filed by Tessera Advanced Technologies in September.


Tessera, which focuses on research and development (R&D) of semiconductor packaging technology, cited two patents in the complaint, saying Samsung had continued using its technology despite a licence having expired.


The disputed products also include notebook computers and cameras that include wafer-level packaged semiconductor components. 


Tessera wants a limited exclusion order and cease-and-desist orders for Samsung’s alleged violations of section 337 of the Tariff Act of 1930.


Tessera’s complaint focuses on US patent numbers 6,784,557 and 6,954,001, called “Semiconductor device including a diffusion layer formed between electrode portions” and “Semiconductor device including a diffusion layer” respectively.


The action was one of several lawsuits filed by Tessera and its subsidiaries against Samsung and its affiliates, with 24 patents cited overall. The inventions cover a wide range of semiconductor processing, bonding and packaging technologies, as well as imaging technologies, Tessera said.


At this stage the ITC has not ruled on the merits of the case, as the complaint will now be handled by an administrative law judge who will make an initial determination.


Jon Kirchner, Tessera’s CEO, said at the time that Samsung’s most recent semiconductor patent licence expired in December 2016, “but we believe it is continuing to use our patented technologies without authorisation, and without paying us fair compensation”.


According to Tessera’s website, it was founded in 1990 by three scientists at an IBM laboratory and originally focused on R&D. Since then it has expanded, including by acquiring FotoNation, “a leader in image and video enhancement and analysis”.



Disney closes in on ‘Dumbo’ mark invalidation


Disney is one step closer to securing the invalidation of a mark it claims is too similar to trademarks for its film “Dumbo”. 


On Tuesday, October 31, the Trademark Trial and Appeal Board (TTAB) published a notice of default covering the mark ‘Dumbo Lounge Sacks’.


California-based company 12th Bean had applied to register the mark for international class 20 (inflatable lounge furniture) in December last year.


As part of its application, 12th Bean filed an image of the furniture that featured the trademark and the face and trunk of an elephant as the letter ‘M’ in the word ‘Dumbo’.


The mark was published in May and Disney filed its opposition in September.


According to the entertainment company, ‘Dumbo Lounge Sacks’ is “highly similar in sound, appearance, and connotation” to Disney’s Dumbo name and marks.


“Indeed, applicant’s ‘Dumbo Lounge Sacks’ mark encompasses opposer’s ‘Dumbo’ mark in its entirety, and ‘Dumbo’ is the first and dominant word in applicant’s ‘Dumbo Lounge Sacks’ mark,” claimed Disney.


Disney added that 12th Bean’s goods are highly related to Disney’s goods, given that Disney has offered furniture-related goods such as pillows, lamps and picture frames.


“Moreover, given the distinctiveness and fame of opposer’s ‘Dumbo’ name and mark, and opposer’s long history of licensing products under its film and character names and marks, consumers are accustomed to seeing opposer’s ‘Dumbo’ name and mark used in connection with a wide range of products and services, including furniture-related products,” added the opposition. 


Disney owns the word mark ‘Dumbo’ for numerous classes, including class 20 for picture frames mirrors and pillows.


12th Bean’s response was due on October 21, but the company did not reply, so notice of default was entered against it by the TTAB.


The California-based company has 30 days from the date of the order to show why judgment by default should not be entered against it.



Adidas opposes another US trademark


German sportswear company Adidas has opposed another trademark at the US Patent and Trademark Office, claiming that the mark infringes Adidas’s ‘three-stripe’ mark.


The allegedly infringing mark, which contains the words ‘3 gold bars’ below three horizontal lines, was filed by Dagoberto Sanchez in May 2016 and covers international class 25 (t-shirts, caps and sweatshirts).


The mark was published in May this year, and Adidas filed its opposition on Monday, October 30.


According to the claim, Adidas has used the ‘three-stripe’ mark on its footwear in the US since 1952, and on other apparel since 1967.


Adidas also said that its marks have been used in connection with the sponsorship of artists such as Katy Perry, Selena Gomez and Kanye West.


“The ‘three-stripe’ mark is nonfunctional, and the public recognises and understands that the ‘three-stripe’ mark distinguishes and identifies Adidas’s merchandise,” said the opposition. 


The ‘3 gold bars’ mark is “confusingly similar” to the Adidas’s mark “in appearance and overall commercial impression”, Adidas claimed, adding that the goods identified are identical and/or closely related to the goods Adidas has offered.


Sanchez must answer the opposition by December 9.


Adidas’s mark has been at the centre of numerous trademark oppositions in the US, including a dispute with Spanish professional football club FC Barcelona.


In March, the football club backed down from the quarrel and abandoned its US trademark application for a mark described as a “square containing seven vertical stripes”.


Adidas has also been in a bitter dispute with retailer Forever 21 about the companies use of stripes on its clothing.


Forever 21 attacked the sportswear company in a declaratory judgment claim filed in March, and Adidas hit back in July.


“Exacerbating matters, Forever 21 also recently offered counterfeit Adidas products for sale on its website (forever21.com), under the false and misleading label ‘Repurposed Adidas’ products,” said Adidas.
